Lawsuit filed on player endorsement

Kraft Foods has issued a lawsuit against the makers of Marshmallow Peeps (http://www.marshmallowpeeps.com/) regarding the use of a hockey player as a spokesman and endorser of their products.

In a legal citation issed June 5th, Kraft Foods has accused Marshmallow Peeps of "encroachment" regarding the use of Pittsburgh Penguins goalie Marc Andre Fleury as a spokesman for advertisements.

"We approached Mr. Fleury immediately after the game 6 loss," stated Kraft spokesman William Keene, "and we verbally agreed to a deal where he would appear in various cheeze commercials. Given his penchant for giving up cheezy goals, it is a perfect fit for Kraft and Mr. Fleury. And it is a fit that we have no intention of sharing with other firms."

But Marshmallow Peeps fired back with their own retort. "We made a deal right after that game, before Kraft ever approached Mr. Fleury," said Peeps director of public relations, Janine Chavez. "Fleury's soft, marshmallow play, combined with his love of giving up soft, juicy rebounds, makes him the perfect spokesman for our line of marshmallow products. We got to Mr. Fleury first, and it is our intent to have exclusive rights to his endorsements."

The legal suit was filed in Pittsburgh District Court. Mr. Fluery, disconsolate after the game 6 loss, was unavailable for comment.

Fleury has improved immensely in the last year. His play during the whole playoffs was great. In the finals he got little support from the rest of the team. Fleury ha nothing to hang his head about as he and the team got further than anyone would have thought.
